AGREEMENT TO MAKE A WILL OR OTHER TESTAMENTARY DISPOSITION THIS AGREEMENT TO MAKE A WILL is made by and between (YOUR NAME) (hereinafter referred to as “DONOR”), a resident of Broward County, Florida and residing at (ADDRESS), and TEMPLE BETH EL, INC., a Florida not-for-profit corporation, having its principal office at 1351 S. 14th Avenue, Hollywood, Florida (hereinafter referred to as “TEMPLE BETH EL”). THE PARTIES AGREE AS FOLLOWS: 1. The DONOR will make a bequest in a Will or equivalent (such as an irrevocable trust) leaving $_________________ of his/her estate to TEMPLE BETH EL. 2. The DONOR will not alter, amend or revoke such Will or equivalent in a manner inconsistent with the provisions of this Agreement, without prior written approval of TEMPLE BETH EL. 3. In consideration of, and in specific reliance upon this generous commitment and pledge by the DONOR, DONOR promises to complete this donation. Further, DONOR agrees this agreement and the commitment herein is binding upon DONOR’s estate, heirs, successors, assigns and trustees. This agreement is deemed to include all trusts and any and all other assets in control of the maker which pass outside of probate upon the death of the maker, and, will be relied upon to the detriment of TEMPLE BETH EL. 4. TEMPLE BETH EL, inspired by DONOR’s irrevocable commitment, and in anticipation of the future receipt as set forth herein, will use DONOR’s pledge, commitment and promise: (a) as collateral to enable TEMPLE BETH EL to secure a loan of $_______________; or (b) TEMPLE BETH EL, as an inducement to others, agrees to spend this amount of $___________ for the specific purpose of ____________________. 5. Further, TEMPLE BETH EL, in consideration of and in specific reliance upon DONOR’s promise and pledge to donate $________________ to TEMPLE BETH EL, and, as an inducement to others, agrees to place DONOR’s name upon __________________ in recognition of the commitment. 6. The DONOR is more than twenty-one (21) years of age and makes this agreement and commitment with free will. 7. Presently, the net value of the DONOR’s estate is in excess of the amount of gift.
